1. The plaintiff's claim is dismissed.
2. The costs of the lawsuit are assessed against the defendant.
Reasons
The plaintiff asserted that he lent money stated in the purport of the claim to the defendant and sought its return by the lawsuit of this case, but it is not sufficient to acknowledge the fact of lending to the defendant by only the statement in Gap 1 through 5 (including each number), and there is no other evidence.
(Plaintiffs (Plaintiff withdrawn the instant lawsuit as of March 29, 2018, but the Defendant did not consent thereto). The Plaintiff’s claim is without merit, and it is so decided as per Disposition.
