1. The Defendant shall pay to the Plaintiff KRW 30,676,00 as well as 20% per annum from November 16, 2017 to the day of full payment.
In full view of the purport of the Plaintiff’s statement and argument as to the Plaintiff’s evidence No. 1, the Plaintiff was employed by the Defendant and retired from office from May 10, 2010 to November 1, 2017, and the Plaintiff filed a petition with the Gwangju Regional Employment and Labor Agency because it was not paid wages and retirement allowances from the Defendant. Accordingly, the labor inspector confirmed the Plaintiff and the Defendant’s statement and prepared “business owner’s confirmation document, such as delayed payment of wages,” and according to the above confirmation, the Defendant was found to have failed to pay the Plaintiff KRW 6,176,00 in total of wages from September 1, 2017 to October 13, 2017.
According to the above facts, the defendant is obligated to pay the plaintiff the total amount of 30,676,00 won of unpaid wages and retirement allowances and delay damages calculated at the rate of 20% per annum from November 16, 2017 to the day of full payment, pursuant to Article 37(1) of the Labor Standards Act and Article 17 of the Enforcement Decree of the same Act.
