The prosecution of this case is dismissed.
Reasons
1. At around 16:48 on July 23, 2016, the Defendant assaulted the victim C (the age of 42) who is an acting engineer and the victim’s face face in the vehicle, and flicked once again, and flicked the victim’s right to flick.
2. The judgment is a crime falling under Article 260(1) of the Criminal Act and cannot be prosecuted against the victim’s express intent under Article 260(3) of the Criminal Act. Since the victim expressed his/her wish not to punish the defendant on December 6, 2016, which was after the prosecution of this case, the prosecution of this case is dismissed in accordance with Article 327(6) of the Criminal Procedure Act.
