A. The grounds of appeal by the prosecutor 1) The defendant asserted the legal principles as follows: (a) the defendant caused the instant accident and caused the same person to take relief measures against the victim; and (b) the person was forced to take care of the victim to the hospital; (c) the victim's guardian was unable to verify the defendant's personal information because his guardian left the hospital at all before the victim entered the hospital without informing the victim of his personal information or contact information at all; and (d) the defendant could not confirm the defendant's personal information by leaving the hospital even after his driver's visit the hospital; and (e) even if he made it possible for the investigative agency to find the actual driver at the latest, the defendant's act constitutes a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (U.S.A.) and the criminal intent of escape can also be recognized. B. The reasoning of the lower court’s appeal is too unreasonable.

2. Determination

A. As to the prosecutor’s assertion of misapprehension of the legal principles, the following circumstances are additionally acknowledged based on the evidence duly examined and adopted by the court below. In other words, the Defendant reported an accident to an insurance company where a harming vehicle was admitted to the hospital immediately after the instant accident (21:30) and the Defendant reported the accident to the insurance company where the harming vehicle was admitted to the hospital, so that the victim can be treated smoothly through insurance processing. In addition, the Defendant reported the content of the instant accident and the instant accident to the G police station located in the Cheong-nam Police Station in Cheong-gu, Chungcheongnam-gu, Cheong-nam, Seoul, about 22:05 by requiring the F to report the accident to the driver of the instant vehicle.
