[2014 Highest 1088] On March 21, 2014, the Defendant received 225,000 won from the victim D to the new bank account (E) in the name of the Defendant, on the ground that he/she had no intent or ability to sell the goods, and that he/she would sell Samsung Galleno Nort 2 via the Internet site (NAV Gain), although he/she did not have an intention or capacity to sell the goods, and in fact, he/she received from the victim D to the new bank account (E) in the name of the Defendant.

4.3.Around March, 200, the victim F was transferred KRW 223,00 from the victim F to the above new bank account by the above method and acquired each of them.

[2014 Highest 1274] On May 18, 2014, the Defendant posted an article 200,000 won on the Internet website (NAV Gain Kafin), even though there was no intention or ability to sell the article, and then falsely expresses that he/she would sell it to the victim G who reported and contacted Samsung G, and then was remitted KRW 210,00 won from the victim’s new bank account (E) in the name of the Defendant.

1. The Defendant, around May 18, 2014, posted 2 sales articles on the bulletin board of Samsung Gagno-ro, Samsung Dogno-ro, without having intention or ability to sell goods, and fraudulently made a false statement that he/she would sell it to the victim H, who reported it, and acquired 50,000 won from the victim to the new bank account (E) in the name of the Defendant on August 21, 2014.

2. Around July 16, 2014, the Defendant posted 2 sales letters on the Internet website (NAVG Gafin), where there is no intent or ability to sell the goods at the place indicated in paragraph (1).
