1. As to the grounds of appeal by the prosecutor, the lower court acquitted the Defendants on the grounds that the Defendants committed fraud related to the land purchase fund for victims E and F among the facts charged.

Examining the record in accordance with the relevant legal principles, the lower court did not err by misapprehending the legal doctrine regarding Amendments to Bill of Indictment and Recognition of Reduction, or by failing to exhaust all necessary deliberations.

Although the prosecutor appealeds the entire judgment of the court below against the defendant, the prosecutor does not state in the petition of appeal or the appellate brief the grounds for objection to the conviction.

2. As to the Defendant A’s grounds of appeal, the lower court convicted Defendant A of the facts charged (excluding the part not guilty in the grounds of appeal) on the grounds indicated in its reasoning.

Examining the relevant legal principles and evidence duly admitted, the lower court did not err by exceeding the bounds of the principle of free evaluation of evidence in violation of logical and empirical rules, or by exceeding the bounds of the principle of free evaluation of evidence, by misapprehending the legal doctrine on the degree of proof, the determination of credibility of the statement, and

3. As to the grounds of appeal by Defendant B, the lower court convicted Defendant B of the facts charged against Defendant B (excluding the part not guilty in the grounds of appeal) on the grounds indicated in its reasoning.

Examining the relevant legal principles and evidence duly admitted, the lower court did not err in its judgment by exceeding the bounds of the principle of free evaluation of evidence against logical and empirical rules, or by misapprehending the legal doctrine on joint principal offenders and assistant offenders, and “ particularly reliable state” as prescribed in Article 313(1) of the Criminal Procedure Act.

4. Therefore, all appeals are dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
