Since then there is no significant change in circumstances to consider the sentencing of defendants.

In light of the prosecutor’s petition of appeal, statement of grounds for appeal, and other factors of sentencing indicated in the trial records, the lower court’s sentence cannot be deemed to be less light, even considering the circumstances alleged by the prosecutor.

Pursuant to Article 364 (5) of the Criminal Procedure Act, the prosecutor's appeal shall be dismissed without oral proceedings.
