1. The Defendant shall pay the Plaintiff KRW 100,000,000 and the interest rate of KRW 15% per annum from February 14, 2018 to the date of full payment.
Comprehensively taking account of the respective descriptions of Gap evidence 1 and 2 and the purport of the entire pleadings, it can be acknowledged that the defendant, while borrowing money from the plaintiff on November 1995, issued and delivered to the plaintiff the check number C, face value C, 100,000,000 won, issue date, Daegu Metropolitan City, Daegu Metropolitan City, Metropolitan City, Daegu, and Dong-dong, Inc., the payment place, and that the plaintiff was refused to pay due to non-transaction even if it was presented to the plaintiff at the new payment place ( Daegu Branch of a National Bank) with the issue date added to the above day on November 23, 2017.
Therefore, the Defendant, the drawer of the check, is obligated to pay the Plaintiff, the holder of the check, the amount of KRW 100,000 per annum from February 14, 2018 to the day of full payment, as claimed by the Plaintiff, to the day following the delivery of a copy of the instant complaint, as well as damages for delay calculated at the rate of 15% per annum under the Act on Special Cases Concerning Promotion, etc. of Legal Proceedings.
The plaintiff's claim of this case is legitimate, and it is so decided as per Disposition by the assent of all.
