1. Defendant C shall pay to the Plaintiff KRW 12,865,340 as well as 12% per annum from February 7, 2020 to the day of full payment.

Reasons

1. Determination as to the claim against Defendant C

A. 1) Defendant C’s marking of the claim is 35 square meters away from the D-road in Sungsung-si (hereinafter “1 land”).

(A) E-road 16 square meters (hereinafter “second-party land”)

3/14 shares among the 3/14 square meters and F-road 34 square meters (hereinafter “third land”).

On March 21, 1983, the registration of ownership transfer was completed on March 21, 1983 with respect to shares in 3/14, and on August 15, 1992, with respect to shares in 3/14, the registration of ownership transfer was completed on August 15, 192 with respect to shares in 3/14, and on February 23, 2007, the registration of ownership transfer was completed on February 23, 2007 with respect to shares in 8/14, respectively. 2) Meanwhile, on February 10, 1984, the Plaintiff agreed to acquire shares in 1,2,3 land through consultation while promoting road construction and other projects on a lot of land in 1,2, and on February 10, 1984, the Defendant C paid 116,20 won out of the compensation amount (=87,400 won equivalent to approximately 199,200 won out of the compensation amount, approximately 26,2005% of the compensation amount equivalent to KRW 26.

3) 그런데 피고 C은 2009년경 원고로부터 다시 제1, 2, 3토지의 협의취득 요청을 받자, 위와 같은 사정을 잘 알면서도 다시 원고로부터 보상금을 지급받기로 하고서, 2009. 6. 30. 경기도에게 제1, 2, 3토지에 관하여 2009. 6. 29. 공공용지의 협의취득을 원인으로 한 소유권이전등기를 마쳐준 다음, 2009. 7. 1. 원고로부터 보상금 22,624,000원(= 제1토지 10,325,000원 제2토지 3,936,000원 제3토지 8,363,000원)을 지급받았다. 4) 따라서 피고 C은 원고에게 이중으로 지급받은 보상금 12,965,340원{= 제1토지 10,170,810원(≒ 10,325,000원 × 0.99) 제2토지 582,250원(≒ 3,936,000원 × 0.15) 제3토지 2,212,280원(≒ 8,363,000원 × 0.26)} 중 피고 C이 2018. 1. 2. 반환한 10만 원을 뺀 나머지 12,865,340원을 반환할 의무가 있다.
