Punishment of the crime
[Criminal Records] The Defendant was sentenced to 10 months of imprisonment with prison labor and 2 years of suspended execution at the Changwon District Court on September 19, 2017 for a violation of the Narcotics Control Act, and the period of suspended execution becomes final and conclusive on the 27th of the same month.

No one shall capture or gather marine animals or plants by means of fisheries other than those under the Act on Fisheries or the Management of Fishery Resources.
그럼에도 피고인은 2017. 11. 1. 시간 불상경 경남 남해군 C 선착장에서 ‘B ’를 타고 출항하여 같은 면 동천 리 내 동천 지선 인근 해상으로 이동한 후, 산소공급장치 등 잠수용 스킨 스쿠버 장비를 착용하고 잠수하여 그 곳 해저에 서식하는 수산동물인 시가 186,000원 상당의 우렁쉥이 등 3kg를 포획한 것을 비롯하여 그 무렵부터 같은 해 12. 27. 경까지 별지 1 범죄 일람표 기재와 같이 총 28회에 걸쳐 수산업법 또는 수산자원 관리법에 따른 어업 외의 어업의 방법으로 우렁쉥이 등 시가 합계 7,655,000원 상당인 139kg 의 수산 동식물을 포획 ㆍ 채취하였다.
