In light of the evidence duly admitted by the court below, the court below is justified in finding the defendant guilty of the modified facts charged of this case (excluding the part not guilty in the grounds of appeal) on the grounds as stated in its reasoning.

In so doing, contrary to the allegations in the grounds of appeal, there is no error of law by misunderstanding facts in violation of logical and empirical rules or by misapprehending the legal principles on the criminal intent of defraudation in fraud.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
