[2019 Highest 2411] On April 14, 2019, the Defendant: (a) committed an act as if he/she had no intent or ability to pay the drinking value in the “D” entertainment drinking club operated by the victim C in Nam-gu Incheon Metropolitan City; and (b) ordered an alcoholic beverage to pay the drinking value normally; (c) he/she received an order from the victim as if he/she had no intent or ability to pay the drinking value; and (d) he/she acquired economic benefits equivalent to the said amount by not paying the said amount, even if he/she received an alcoholic beverage amounting to KRW 270,00,000, including the amount of alcoholic beverage service (105,000,000) and the amount of alcoholic beverage service (30,000,000,000 won) from the victim.

[2019 Highest 3673] The Defendant, at around 2019, 4, 12, 21:00, at the main point of “G” operated by the Victim F in Bupyeong-gu Incheon, Bupyeong-gu, Incheon, the Defendant, despite having no intent or ability to pay the drinking value, took the place as if he would normally pay the drinking value, and ordered the drinking and alju as if he would normally pay the said value, and the Defendant did not pay the said value and acquired the pecuniary benefits equivalent to the said amount by failing to pay the said value.

1. At around 10:30 on February 11, 2019, the Defendant: (a) obtained one resident registration certificate owned by the injured party who was lost by the injured party J; (b) one credit card of the KB National Bank; (c) one credit card of the new bank; (d) one credit card of the Korean bank; and (e) two credit card of the KB bank; and (e) two Kakao Bank Bank Co., Ltd.; and (e) one 1,000,000,000,000 in the market price of the Central University Hospital Hospital Hospital Card; and (e) did not take necessary procedures, such as returning it to the injured party.
