피고인들과 E(2017. 9. 26. 기소 중지 처분) 는 창원시 마산 합포구 F에 있는 폐업한 공장을 임차 하여 게임 장을 운영하기로 하면서, E는 위 게임 장의 실업 주로서 위 게임 장 운영을 총괄하는 역할을, 피고인 A는 위 게임 장에서 손님들이 획득한 점수를 현금으로 바꾸어 주는 환전상의 역할을, 피고인 B은 위 게임 장의 바지 사장 역할을, 피고인 C은 손님들을 태워 위 게임 장에 데려 다 주는 속칭 ‘ 깜 깜이’ 차량 운전자 역할을 하기로 모의하였다.
