도로법위반
The defendant shall be innocent.
1. Around 12:05 on August 5, 200, the Defendant violated the restriction on the operation of vehicles by the road management authority by: (a) Party C, an employee of the Defendant, around the Korea Highway Corporation located within four kilometers of the Hanyang Highway; (b) loaded and operated freight in excess of the limitation on the storage weight of D freight vehicles owned by the Defendant in connection with the Defendant’s business.
2. Since the penal provisions applied to a summary order subject to review have retroactively lost effect according to the Constitutional Court’s decision of unconstitutionality, the Defendant is acquitted in accordance with the former part of Article 325 of the Criminal Procedure Act.
