A person who intends to convert a mountainous district shall obtain permission from the Administrator of the Korea Forest Service, etc. according to classification of mountainous districts specified by Presidential Decree, size, etc.

Nevertheless, on May 20, 2018, the Defendant, without obtaining permission for the diversion of a leisure market, destroyed mountainous districts and constructed roads using one unit of excavation equipment in the area of part of the forest and fields B, which is a preserved mountainous district, from around 585 square meters, by using one unit of excavation equipment, which is around 585 square meters in the area of the forest and fields B, a preserved mountainous district, and buried the ground as a concentrated rain, and by using the same method as gravel or stone, etc., without obtaining permission for the diversion of a leisure market.
