A defendant shall be punished by imprisonment for six months.
Punishment of the crime
On November 3, 2016, the Defendant was sentenced to a suspended sentence of two years on the 11st of the same month, due to a violation of the Road Traffic Act, in the Goyang Branch of the District Court, and the judgment became final and conclusive on the 11st of the same month.
On December 2, 2013, the Defendant: (a) committed D’s housing construction work around early December 2, 2013; (b) attempted to borrow money from another person by forging documents in the name of D; (c) had D used documents related to the completion of housing construction to change the name of the head of the house and the certificate of the seal imprint; and (d) received a false statement.
On December 4, 2013, the Defendant: (a) intended to borrow KRW 100 million from G from 'F' office located in 'E', in order to borrow from 'F' office; (b) using the certificate of personal seal impression and the ledger of personal seal impression issued by D as above, the Defendant prepared each of the "authorized D's name to prepare a document of monetary consumption and loan contract in D; (c) the "certificate of loan" in the name of D with D as the obligor; and (d) the "representative certificate" in the name of D for the certification of the above loan certificate; and (d) forged the above document by affixing the seal affixed to the name of 'F' office; and (d) presented it to the notarial staff of the law firm who is aware of the forgery.
At the same day, the Defendant continuously prepared a “written promise for land purchase” under the name of D to sell and purchase I land to G in the “Certified Judicial scrivener H office located in Dong-si, Gyeonggi-do, and a “written promise for land purchase and sale” under the name of D to the effect that he/she would sell and sell the said land to G, and a “written contract for land purchase and sale” under the name of D to the effect that he/she will delegate the said affairs to the said certified judicial scrivener, and each of the above documents was forged by affixing his/her seal attached thereto, and each of the above documents was presented to the employees of the said certified judicial scrivener office who may know that it was forged.
Accordingly, the defendant is entitled to letter of delegation in the name of D, letter of borrowing, letter of promise to trade land, and one copy of land transaction contract, which are private documents related to rights and obligations.
