1. Basic facts
A. The Plaintiff is a “A” located in Yeonsu-gu Incheon Metropolitan City, which is an aggregate building (1,596 households for the aggregate building), and <2> non-residential business facilities and commercial facilities for eight non-residential buildings from A to H Dong (1,058 households for business facilities and officetels, 295 households for commercial facilities, and hereinafter collectively referred to as “officetel, etc.”).
) The outside is composed of roads, etc., and the entire aggregate building constitutes a single complex; hereinafter referred to as the “instant aggregate building,” among residential and non-residential parts, is the council of occupants’ representatives of the residential apartment part; Defendant A Steering Committee (hereinafter referred to as the “Defendant Committee”) is an integrated committee composed of representatives of each building, such as officetels, for the integrated management of business facilities and commercial facilities among the instant aggregate buildings; Defendant B is the sectional owners of some households of officetels.
B. In the entrance connecting the instant aggregate building to the outside, there is a dynamic and letter allowing access to any one of the above residential apartment buildings, officetels, etc. (hereinafter “joint access door”), and in the center of the aggregate building complex, a waterway for landscaping, etc. is installed. The central waterway is used by all occupants, such as residential apartment residents or officetels.
C. On April 7, 2014, the Plaintiff entered into a housing well-being and security service contract with the Home Co., Ltd., and on March 2, 2014, the Plaintiff managed the aggregate building facilities including the above joint entrance and central waterway by entering into a contract for the service of cleaning and sanitation management services with the new T&C Co., Ltd. on March 2, 2014.
After the establishment of the Defendant Committee, the Plaintiff is against the Defendant Committee the cost of managing the above common facilities (i) the maintenance and repair of the common access facilities, (ii) the security service cost for the common access questions ( personnel expenses, ③ the central waterway management cost of the said condominium buildings, etc.).
