A. On December 2, 1966, the registration of transfer of ownership in the name of J was completed on December 7, 1966 with respect to the land of 93 square meters (hereinafter “the land before the instant subdivision”) in Gangnam-gu Seoul Metropolitan Government.

B. The J died on September 5, 1979, and the defendant C, D, E, and F, who is the defendant B, his spouse, and the defendant C, D, E, and F, who is the defendant B, his spouse.

After that, on May 4, 2002, K died and the Defendants inherited K.

C. L newly constructed a lushes and colon’s house of 28.69m2 and an affiliated 2.51m2 (hereinafter “instant building”) on the ground of 106m2 adjacent to the instant land prior to the instant partition (hereinafter “Plaintiff’s land”), which was located on March 31, 1969, and completed the registration of ownership preservation on May 7, 1971.

After that, on November 19, 1983, the registration of transfer of ownership in the name of the plaintiff was completed on November 21, 1983 on the building of this case due to the sale as of November 19, 1983, and on March 20, 2013 on the inheritance due to the division as of March 20, 2013.

On January 5, 191, the land prior to the instant subdivision was divided into five square meters in Gdae-gu Seoul Metropolitan Government (hereinafter “instant one real estate”) and 11 square meters in HJ (hereinafter “instant two real estate”).

E. Among the instant real estate 1, the instant building has been constructed with a part of 4 square meters inside the ship connecting each point of the items indicated in the annexed drawing Nos. 8, 5, 6, 7, and 8 (hereinafter “influent part”) and two real estate of this case.

2. The assertion and judgment

A. On May 7, 1971, which was after LJ acquired the ownership of each of the instant real estate, the part of the instant real estate out of the land of the instant building and the possession of the instant two real estate was commenced as the site for the instant building, and on November 21, 1983.
