[2014Gohap35], [2014Gohap70 (Defendant B] Defendant A was in office as the head of the hospital of the “AB hospital” (hereinafter “AB hospital”) affiliated with the Zaco-Gun Medical Foundation (hereinafter “AA hospital”) from around 2006 to May 2013, Defendant A was in office as the head of the hospital of the Zaco-Gun Medical Corporation (hereinafter “AB hospital”) from around 2000, and Defendant B was in office as non-medical person between A and the private village, and is the president of the medical corporation and the president of the Medical Corporation Foundation from around June 2013 to the date.

1. Defendant A

A. The Defendant, in violation of the Act on the Aggravated Punishment, etc. of Specific Economic Crimes (Fraud) and the Subsidy Management Act (1) commits the crime related to the mental and grading with the mind and the hospital (including the mental and medical ward), abuse that the hospital grade (G1-G5) is determined according to the level of human resources for medical service (including doctor, nurse, specialist, and patient ratio), and that the medical expenses of the first-class and second-class medical care patient are differently paid according to the said class. The Defendant abuses that medical doctors and nurses are falsely registered to the hospital and obtains a higher rating from the National Health

(3) On October 208, 2008, the Defendant: (a) filed a false registration of nine licenses, such as doctor AD and nurse AE, at AA Hospital; and (b) filed a false registration of such nine licenses with the Health Insurance Review and Assessment Service (hereinafter referred to as “Health Review and Assessment Service”).

(2) The Defendant filed a claim for medical expenses, and filed a claim for the amount of G2 grade with the Defendant, and received the amount of 331,162,00 won (264,929,600 won, Jeonnam-do, 39,440 won, and Youngnam-do, 26,492,960 won (26,960 won of the Ministry of Health and Welfare, 264,929,960 won), out of the amount deposited by the Defendant (264,929,960 won), from the Defendant, and received the amount of 331,162,00 won (264,929,960 won of the Ministry of Health and Welfare, and received the amount of subsidies from the Service, and received the amount of subsidies from the Service.
