1. The defendant's appeal and the plaintiff's incidental appeal are dismissed, respectively.
2. Costs arising from an appeal and an incidental appeal shall be respectively.
Reasons
1. The reasoning of this court’s acceptance of the judgment of the court of first instance is the same as that of the judgment of the court of first instance, and thus, this is acceptable in accordance with the text of Article 420 of the Civil Procedure
2. The judgment of the court of first instance is justifiable, and all the defendant's appeal and the plaintiff's incidental appeal are dismissed as it is without merit.
