The prosecution of this case is dismissed.
Reasons
1. Around July 10, 2016, around 14:55, the Defendant assaulted the victim in a way that the victim D (63 taxes) did breath in the construction site of the factory site located in Sacheon-si, Sacheon-si, against the breath’s defect, thereby making the victim batling and batling the bats of the victim.
2. Article 260(1) of the Criminal Act applicable to the facts charged for judgment: A judgment dismissing a public prosecution on February 8, 2017, which is the third public trial date after the prosecution of this case under Article 260(3) of the Criminal Act; the victim expressed his/her intention not to want punishment by attending this court: Article 327 subparag. 6 of the Criminal Procedure Act
