1. The Defendant shall pay to the Plaintiff KRW 21,706,908 and the interest rate of KRW 20% per annum from November 30, 2019 to the day of full payment.
1. The Plaintiff entered into an employment contract with the Defendant and retired from office from office from office from August 1, 2017 to November 15, 2019. The Plaintiff did not receive wages of KRW 2,565,000 and retirement allowances of KRW 6,056,908 from the Defendant; the Plaintiff received KRW 300,000,000 on November 30, 2019, KRW 10,000,000 on December 19, 2019, and KRW 4 million on February 10, 2020 from the Defendant; or there is no dispute between the parties, by taking into account the overall purport of arguments as stated in subparagraphs A through 7.
Therefore, pursuant to Article 37(1) of the Labor Standards Act, the Defendant is obligated to pay to the Plaintiff 21,706,908 won and damages for delay calculated at the rate of 20% per annum from January 15, 2019, the retirement date of the Plaintiff, to November 30, 2019 to the date of full payment.
2. In conclusion, the plaintiff's claim is justified and it is so decided as per Disposition.
