1. The Defendant: (a) KRW 80 million to the Plaintiff; and (b) 15% per annum from December 15, 2018 to May 31, 2019 to the Plaintiff.
If the purport of Gap evidence Nos. 1 through 4 and the whole purport of the pleadings is terminated, the plaintiff can be found to have lent 80 million won to the defendant on December 8, 2016.
Therefore, the Defendant is obligated to pay to the Plaintiff 80 million won with 15% interest per annum as prescribed by the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings before Amendment from December 15, 2018 to May 31, 2019, and 12% interest per annum as prescribed by the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings from the next day to the day of full payment.
The plaintiff's claim shall be accepted on the grounds of its reasoning.
