피고인은 2019. 10. 12. 21:35경 대구 북구 B에 있는 피해자 C(63세)의 배우자가 운영하는 ‘D’ 식당에서, 그 곳에 있던 피해자와 합석하여 술을 마시던 중 피해자가 “이것 드시고 들어가세요.”라고 말했다는 이유로 “나를 건드리면 다친다.”라고 말하며 피해자의 가슴을 1회 쳤고, 이에 피해자가 빨리 나가라고 하자 화가 나 피해자를 살해할 것을 마음먹고 “죽인다. 칼 어딨노. 칼 있나.”라고 하며 주방으로 들어가 그 곳 주방에 있던 식칼(칼날길이 22cm, 전체길이 32cm)을 들고나와 피해자의 가슴을 찌르려고 수회 휘두르다가 피해자의 팔 부위를 찔렀고, 계속하여 위 식칼을 휘둘렀으나 피해자가 밖으로 도망쳐 미수에 그쳤다.
