The prosecution of this case is dismissed.
1. Around 09:00 on September 25, 2015, the Defendant, at the senior citizen center located in the Seoul Special Metropolitan City, Nowon-gu Seoul Special Metropolitan City C apartment complex, brought a dispute with the victim D(75 years of age) and the above senior citizen center as a matter of distribution of the name of the victim and the above senior citizen center, and assault the victim by taking the victim’s bath, and booming him.
2. In light of the above, the case is a crime falling under Article 260(1) of the Criminal Act, which cannot be prosecuted against the victim’s express intent under Article 260(3) of the Criminal Act. According to the records on the withdrawal of a complaint filed in the records, it is recognized that the victim has withdrawn his/her wish to punish the defendant on December 1, 2016, which is after the prosecution of this case. Thus, the prosecution of this case is dismissed pursuant to Article 327(6) of the Criminal Procedure Act.
