(4) In light of the above legal principles, the court below held that the Plaintiff’s assertion was justifiable and remanded to the court below for the first time of pleading on the ground that the Plaintiff did not appear on the date of pleading on the ground of pleading. The court below did not err by misapprehending the legal principles on the scope of pleading, or by exceeding the bounds of the principle of free evaluation of evidence, or by exceeding the bounds of the principle of free evaluation of evidence.
