The prosecution of this case is dismissed.
Reasons
1. On September 12, 2019, the Defendant publicly insultingd the victim by stating that “The C Burial Headquarters Representative E is a fraud change,” without any reason, to a public prosecution other than D, who is an employee at a “C Burial” located in Guro-gu Seoul Metropolitan Government, and is aware of the C Burial Store opening business.
2. Determination
(a) Applicable provisions of Acts: Article 311 of the Criminal Act;
(b) Crime subject to prosecution upon complaint: Article 312 of the Criminal Act.
(c) Reasons for dismissing public prosecution: Subparagraph 5 of Article 327 of the Criminal Procedure Act;
