On August 19, 2008, the Defendant made a false statement to the victim AV at the AU coffee shop located in the Busan East-gu, Busan-gu, Busan-si, stating that “The amount of daily distance transported to earth and sand at the nuclear power plant site shall be changed to KRW 10 million.”

However, even if the defendant received the above money from the injured party, the defendant did not have the intent or ability to introduce the distance from the work site of the nuclear power plant to the injured party.

As such, the Defendant, by deceiving the victim, received 10 million won from the injured party as a intermediary fee, and acquired it by money.
