A defendant shall be punished by imprisonment for three years.
However, the execution of the above punishment shall be suspended for five years from the date this judgment becomes final and conclusive.
Punishment of the crime
1. On July 31, 2013, at around 11:00, the Defendant: (a) talked to the effect that “A victim F (F) was no longer contacted with the Defendant and said F (F) was no longer able to communicate with the Defendant at the time; (b) was taken in a taxi with a view to murdering the victim by getting the victim into the H market located in the city of Busan, which is a dangerous weapon in the vicinity of the victim’s residence; and (c) was in possession of the victim by purchasing two brucs (33cc and 23cc in total length) (3cc and 23cc) at the I iron shop in the vicinity of the victim’s dwelling; and (d) was prepared for murder, such as murdering the victim.
2. Around 13:00 on July 31, 2013, the Defendant arrested the victim by talking to the effect that the victim seems to have come into his/her residence before the victim E (n, 33 years of age) located in the Busan Y-gu, Busan Y, and by purchasing the victim and moving the victim to the said HH market with the victim to show his/her view, and taking a bath, etc., from that time, he/she could not return home for about six hours from that time by threatening the victim.
3. Around August 1, 2013, at least 02:30, the Defendant, by threatening the victim E to the effect that “I will not see how I will do so,” and by threatening the victim E to the effect that “I will die,” as in the preceding paragraph, the Defendant, as in the preceding paragraph, made the victim, who had already been frighted, failed to resist to return to the victim, and had the victim, who had already been frighted, and had the victim do sexual intercourse once with the victim.
4. No person who violates the Act on Promotion, etc. of Information and Communications Network Utilization and Information Protection shall allow anyone to repeatedly reach the other party any language or text creating fear or apprehension through information and communications networks.
