The defendant is a person who resides in the Heak-gu Seoul Metropolitan City B apartment house 509, 902, and is engaged in his own business (automobile repair shop).

On August 2012, the Defendant, at the end of the Cheongju-si, destroyed an illegal forest by breaking a size of 126 square meters on the upper part of the retaining wall in order to complete the slope of the retaining wall while installing the retaining wall on the slope surface of D and E land owned by the Defendant, adjacent to the Heung-gu C forest in the Cheongju-gu, Chungcheongnam-gu.

In order to divert a forest, anyone is required to obtain permission to divert the forest under Article 14 (1) of the Mountainous Districts Management Act, but the defendant damaged the forest by misunderstanding the boundaries without obtaining permission to divert the forest, thereby causing damage to the forest in accordance with the standard amount of recovery expenses for mountainous district publicly notified by the Korea Forest Service in 2012.
