1. The defendant shall pay to the plaintiff KRW 45,320,806 and KRW 43,698,674 from February 13, 2020 to the day of full payment.
According to the facts without dispute, Gap evidence Nos. 1-4 and the purport of the entire pleadings, the defendant concluded a long-term siren agreement with the plaintiff on November 9, 2018 (3,81.8,000 won, 60,000 won, 60 months, 931,480 won, 17 days of settlement date), and the defendant agreed to pay damages for delay in the event that the plaintiff delayed the performance of his/her obligation, the plaintiff's compensation rate for delay is 24% per annum, and the defendant's unpaid principal as of February 12, 2020 is 43,698,674 won, interest 1,357,373 won, and late payment charge is 264,759.
Therefore, the Defendant is obligated to pay to the Plaintiff damages for delay calculated at the rate of 24% per annum as stipulated in the agreement from February 13, 2020 to the date of full payment, with respect to the unpaid principal under the long-term siren agreement and the unpaid principal of KRW 45,320,806, and the unpaid principal of KRW 43,698,674, among them, from February 13, 2020 to the date of full payment.
