A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
1. At around 19:00 on October 8, 2019, the Defendant violated the Road Traffic Act (hereinafter “Road Traffic Act”) driven a DNA siren car on the front side of the Jeonsung-gun apartment Cdong.
In this case, a driver of a motor vehicle shall not drive a motor vehicle under the influence of alcohol, and has a duty of care to drive the motor vehicle safely by accurately manipulating the steering gear and brake system of the motor vehicle.
Nevertheless, the Defendant neglected this, while driving a motor vehicle with a blood alcohol level of 0.103% without putting the front room properly while under the influence of alcohol level 0.103%, and caused hW 530i vehicle in front of the victim E, which is owned by the victim E, and HW 530i vehicle, which is owned by the victim G, and caused hW 523,923 won to repair the above high-speed motor vehicle, and damaged the above BM 530i motor vehicle to take 1,55,79 won for the repair cost.
2. The Defendant violated the Road Traffic Act (driving a sound driving) driven the rocketing car described in paragraph (1) while under the influence of alcohol at a section of about 500 meters from the front day of the Hosung-gun B apartment C apartment zone to the entrance of I village at approximately 0.103% of blood alcohol level.
