A. Defendant B, in violation of the Act on the Promotion of the Game Industry of Defendant B, registered as a general game room with the office of Chungcheongnam-si on May 4, 2015, and thereafter operated a general game room with the name of “F” room in Chungcheong-si E from that time.

No game products-related business entity shall allow any person to gamble or perform other speculative acts by using game water, or leave such person to do so.

Nevertheless, on May 15, 2015, Defendant B received 80,000 won per 10,000 won per coophone and sold 10,000 won per coophone to Defendant A, who was found as a customer at around 20:00, and had Defendant A access to the said coophone to the “G” website by allowing Defendant A to play a game (the game in which a person with a card of less than one different pattern or number, among the remaining cards, conducts betting (3 times after having received the card 4) and eventually bring a little amount of betting) by allowing customers to acquire a game machine according to a friendly outcome, and make customers easily exchange the remaining game machine with a coophone or make it possible for customers to play a game again as much as the game machine stored in the said coophone.

As such, Defendant B caused customers to engage in gambling and other speculative acts using the above game water.

B. From around 20:00 on May 15, 2015 to May 16, 2010, Defendant A paid 80,000 won for each operator’s 10,000 won for each 10,000 won from Defendant B’s PC on May 16, 2015, and purchased 80,000 won for each 10,000 won for each cubon from Defendant B to “G” site for about 4 hours after having access to the said cubon (the way of bringing about the total amount of betting amount by a person who has a different pattern or a lower number of the cards among the remaining cards).
