1. The Defendant shall pay to the Plaintiff KRW 34,135,00 and interest rate of KRW 15% per annum from July 29, 2017 to the day of complete payment.
Comprehensively taking account of the absence of dispute and the purport of the entire evidence pleadings submitted by the Plaintiff, the Plaintiff supplied the Defendant with human resources at the new construction site B located in the Sinju City from March 1, 2017 to May 23, 2017, but it can be recognized that the Defendant did not pay the labor cost of KRW 34,135,00.
Meanwhile, the Defendant asserts that the labor cost should be repaid by the original owner alternative construction corporation, who is not the Defendant, but the Defendant, but the Defendant’s obligation to pay the labor cost to the Plaintiff by a contract with the Defendant, unless the Plaintiff agreed to exempt the Defendant from the Defendant’s obligation, is not completely extinguished.
Therefore, the defendant shall pay to the plaintiff 34,135,00 won with 15% interest per annum from July 29, 2017 to the day following the delivery of a copy of the complaint of this case.
