1. The instant lawsuit shall be dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
The plaintiff shall seek payment of the amount stated in the purport of the claim on the grounds as shown in the attached Form.
However, comprehensively taking account of the description of the evidence No. 1 and the purport of the entire argument, it can be acknowledged that the Defendant’s immunity granted by the Incheon District Court Decision 2016, Nov. 30, 2016, became final and conclusive on December 15, 2016 with immunity granted by 2067. Thus, the instant lawsuit seeking the payment of a loan incurred prior to such immunity is unlawful as there is no benefit in the protection of rights, and there is no benefit in the protection of rights.
Therefore, we decide to dismiss the instant lawsuit and decide as per Disposition.
