On May 23, 2012, the Defendant was awarded a contract with the victim C for a new construction of electric power resource housing (hereinafter “instant housing”) located in D at the Namyang-si (hereinafter “instant housing”) in the cost of construction of KRW 200 million.

On October 2012, after most of the installation works for a yellow-house in the instant house was completed, the fire was destroyed by considerable parts, such as the roof, walls, etc. of the instant house, which occurred again on November 4, 2012, due to a fire that was destroyed by a yellow-house fire that was destroyed by a yellow-house in the yellow-house.

As can be seen, there was a bilateral dispute as to whether the cause of a fire occurred in relation to the fire that occurred in the instant house due to C’s negligence in the process of preventing the fire, and due to the Defendant’s negligence in the construction. While such dispute was pending, the Defendant, around November 2012, completed all construction equipment and materials including the construction vision at the site of the instant house construction work.

On the other hand, around March 2013, C notified the Defendant that the instant contract for new housing construction works is terminated, and C selected E as a new construction business operator from May 27, 2013 to have him/her perform the instant housing repair works. On the other hand, around May 31, 2013, the Defendant prevented the Defendant from performing repair works, including remaining removal works, and did not follow it.

On June 10, 2013, the Defendant stored one container at the site of the instant housing repair work site, parked one F freight vehicle on the access road to the said site. On June 10, 2013, the Defendant interfered with C and E’s work progress by force by obstructing the entry of the E side, in which the Defendant and the Defendant mobilized at the same site on the same 08:00 of the same month, together with two persons mobilized by the Defendant and the Defendant, to bring in materials for repair work.
