A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
No person shall injure his body or commit a deceitful act with the intention of evading military service or having military service reduced or exempted.
On October 7, 2009, the Defendant received a draft physical examination from the Chungcheongnambuk Military Affairs Administration and received a judgment of enlistment in Grade III in active service, and tried to reduce or exempt military service by a deceitful act as if there are mental symptoms for the purpose of military service reduction or exemption.
Around August 12, 2016, the Defendant was provided with medical treatment with the Cheongbuk-do Hospital Hospital B, and then was flicked at 3 to 4 p.m. at home. The Defendant’s computer at home is flicked at 7 p.m. at night. At night, the Defendant was provided with a diagnosis for military affairs on November 2, 2017, following symptoms, such as a chromatic rain, inorganic power, inorganic relationship, evasion, and WIG disorder. On October 23, 2017, the Defendant was issued with a diagnosis for military affairs on the following grounds: (a) the Defendant was provided with a psychological examination at the above hospital, accompanied by a guardian’s mother; (b) the Defendant was provided with a flick-do attitude, and (c) the Defendant did not contact with the mother at all at night, and (d) the Defendant was urged to undergo a new draft physical examination, and (c) the Defendant was provided with an average of 17 draft physical examination and draft physical examination.
However, in fact, the Defendant was serving as an insurance solicitor from April 18, 2017 to February 21, 2018, and was performing a normal social life by purchasing and driving a car in the name of land C from September 13, 2017 to June 26, 2018.
Accordingly, the defendant has written a fraudulent act with the intention of evading military service or having military service reduced or exempted.
