1. Basic facts
A. The Plaintiff is an insurer who entered into an automobile insurance contract with the insured and the insurance period from September 28, 2012 to September 28, 2013 (hereinafter “instant insurance contract”); Defendant Samsung Fire and Marine Insurance Co., Ltd. (hereinafter “instant insurance contract”) entered into a sales liability insurance contract with the new development company (hereinafter “new development”) and the insured’s new development and lessee, and each lessee, and the insurance period from March 25, 2013 to March 25, 2014. Defendant Samsung Heavy Industries Co., Ltd. (hereinafter “the instant insurance contract”) is the contractor of the instant construction work located in Seocho-gu Seoul (hereinafter “instant construction work”).
B. On April 11, 2013, Defendant Samsung C&T entered into a lease agreement on the instant construction project, including the installation and dismantling of a workshop with respect to the new friendship development and the four workshops, and New C&T entered into a subcontract to F, which is operated by E.
On April 10, 2013, New Co., Ltd. leased the instant flag from A, the owner of the instant vehicle, along with the article, for the installation of a workshop at the site of the instant construction.
C. At around 11:35, Apr. 14, 2013, G, an engineer of the instant flag, was engaged in the assembly of booms by using boomers of the instant flag at the site of the instant construction project, with respect to the installation of a boom at the site of the instant construction project. However, during the construction, the booming connected with a boomr during which the boom booms came up to the boom boom, and was around the bee in the vicinity of the bee, and as a result, there was an accident that led to the death of E (hereinafter “instant accident”).
