A. On August 17, 2015, the public announcement of the instant case and the Defendant’s Intervenor’s Intervenor’s Intervenor’s Intervenor (hereinafter “ Intervenor”) decided to grant subsidies of KRW 560,00,000 to the Defendant regarding the new construction of the Environment-Friendly Agricultural Products Supply Center (hereinafter “instant construction”) on August 17, 2015, and decided to act on behalf of the Defendant for the bid to select a contractor for the instant construction project pursuant to Article 8 of the Act on Contracts to Which a Local Government Is

Accordingly, on August 21, 2015, on behalf of the defendant, the intervenor issued a public notice of tender regarding the construction content, amount, etc. of the instant construction in the name of the defendant (hereinafter “instant public notice of tender”).

Matters related to the separate management of labor costs and the implementation of the procedures for verifying payment shall be as follows:

▷ 원도급자는 매월 모든 근로자(하도급자 근로자 포함)의 노무비 청구내역을 발주기관에 제출하여야 하며, 5일 이내에 근로자 개인계좌로 노무비를 이체하여야 합니다.

(제7항 이 사건 입찰공고(을 제1호증)에는 제8항으로 기재되어 있으나 이는 제7항의 오기임이 명백하다. 마목) ▷ 노무비 구분관리 및 지급확인제: 계약상대자는 지방자치단체 입찰 및 계약 집행기준 제13장 제9절에서 정한 바에 따라 노무비의 구분관리 및 지급확인 절차를 이행하여야 합니다.

B. On August 31, 2015, including the preparation of the instant contract form, the Plaintiff and the Defendant drafted each contract form (hereinafter “instant contract form”) with regard to the instant construction project with regard to “from August 31, 2015 to November 28, 2015, the contract price of KRW 549,470,00, and advance payment shall not exceed 70% of the contract amount” (hereinafter “instant contract form”).

The contract document of this case is classified and managed by the labor cost in the public announcement of this case.
