피고인은 2020. 3.경 인터넷 포털사이트에서 일자리를 검색하던 중 “ㅈㄱ(중고) 찍어준다”는 광고를 보고 C에게 텔레그램으로 연락하여, 피고인은 C에게 신분증 사진, 계좌번호, 전화번호, 인터넷사이트 D 아이디 등을 제공하고, C는 중고물품을 판매할 것처럼 피해자들을 기망하여 피고인 명의 계좌에 피해금원을 입금하게 하고, 피고인은 위와 같이 입금된 돈의 절반을 C가 지정하는 계좌로 이체하여주기로 결의하였다.
