1. Basic facts
A. On March 20, 2013, the Lessee entered into a lease agreement with D, the former owner of the instant building, with respect to the part “A” (hereinafter “instant building C”) indicating the drawings on the first floor among the real estate listed in the separate sheet No. 1 (hereinafter “instant building”) from April 1, 2013 to July 30, 2015, with the lease term of KRW 50,000,000, monthly rent of KRW 300,000, and on the same day, the Plaintiff entered into a transfer agreement with D, the former owner of the instant building, with the F, who operated the “E All-time viewing store” (hereinafter “instant restaurant”).
B. On the other hand, on July 23, 2012, F submitted a food restaurant business report with respect to the instant restaurant to the Busan District Office, and registered the food restaurant’s address as “G” with the erroneous report of F, in the column of the place of business, to verify whether the business trip to the instant building was wrong to verify whether it satisfies the facility standards under Article 36 of the Food Sanitation Act, on July 25, 2012, F made a business trip to the instant building and entered as “G,” but the food sanitation business management system was registered as “G,” the address of the said restaurant was falsely reported by F.
C. On March 20, 2013, the day when the Plaintiff entered into a provisional lease agreement, the Plaintiff submitted the said report by stating “A”, “A” in the name column of the person succeeded to the succession to the status of food business operators to the restaurant of this case, “one floor of the K Building in J” in the address column of the successor, and “one floor of the K Building in J in YU-gu, YU-gu” in the location of the place of business.
On March 20, 2013, which is the date of reporting the succession to the status of the food business operator of the counter-resident on March 20, 2013, the public official in charge of the Busan Metropolitan City Office shall be the location of the restaurant in this case under the food sanitation management system.
