A. The Plaintiff is a company engaged in the manufacture and export and import of textile products, and the Defendant is a foreign corporation located in the Bennam Benanan-do, which is engaged in the clothing manufacturing business, etc.

B. The Plaintiff entered into a contract on the export of a total of 25,077 punishment for male and female occupancyers under the terms of FOB from June 25, 2014 to July 30, 2014.

C. On March 20, 2014, the Plaintiff entered into a contract with the Defendant on March 20, 2014 with a view to implementing the contract with the said buyer, and the Defendant will manufacture the said clothing and load it at the port of Hochi, but the Plaintiff provided raw materials necessary for the processing of the said clothing, etc. (hereinafter “instant contract”).

On May 9, 2014, the Defendant manufactured the above clothing in accordance with the instant contract, and the Plaintiff paid USD 120,000 to the Defendant as the contract amount.

The Defendant loaded some of the clothing manufactured as above at the Hosi Civil Port, and stored the remainder of 3,336 punishment (hereinafter “instant clothing”) in the Defendant’s factory warehouse.

E. On the other hand, on May 2, 2014, China had a dispute between Vietnam and China regarding the installation of oil drilling equipment in the vicinity of the Pakistan system, and during the said dispute, there was a case involving the injury inflicted by the guard members of Vietnam and the damage of Vietnam.
