1. Of the plaintiffs' small amount of 4,485 square meters, the attached appraisal map No. 17,20,8,9,9,19,18, and 17 are indicated respectively.

Reasons

1. Facts of recognition;

A. The Plaintiff is the owner of 22,776 square meters of G forest land in Gyeonggi-gun and 1,779 square meters prior to H (hereinafter “Plaintiff-owned land”). The Plaintiff is the owner of 49,587 square meters of F forest land (hereinafter “Plaintiff-owned land”) and the Plaintiff is the owner of F forest land 49,587 square meters when they are created with the Plaintiff’s land owned by the Plaintiff.

B. The Defendant is an owner of the 1stm258m2, JJ 274m2, the 72m2 before K, the 106m2 and the 57m2 of L road, the 106m2.

다. 원고들 소유 각 토지는 지적도상 맹지이고, 경기 양평군 E 도로 106㎡(이하 ‘이 사건 통행로’라 한다)는 콘트리트로 포장이 되어 있는데, 피고는 별지 감정도 표시 1, 12를 연결하는 선 ㈏ 부분 위에 있는 철문을 설치하여 위 도로의 일반 통행을 막고 있다. 라.

2. Determination on the cause of the claim

가. 주위토지통행권 확인 부분에 대한 판단 1 구거 주위토지통행권 확인 부분의 적법여부에 대한 판단 직권으로 경기 양평군 D 구거 4,485㎡ 중 별지 감정도 표시 17, 20, 8, 9, 19, 18, 17의 각 점을 순차로 연결한 선내 ㈅ 부분 9㎡에 대한 주위토지통행권 확인 부분의 적법여부에 관하여 본다.

원고들은 이 사건 통행로와 더불어 피고에 대하여 위 선내 ㈅ 부분 9㎡에 관하여도 주위토지통행권 확인을 구한다.
