2. Determination can be taken into account: (a) the Defendant’s mistake is recognized; and (b) the circumstances in which there was no past criminal record.

However, in full view of the fact that there is no letter from the victim until now, and the sentencing conditions under Article 51 of the Criminal Act, the sentencing of the court below is acceptable, and there is no unreasonable ground for the defendant to assert.

3. In conclusion, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act since it is without merit. It is so decided as per Disposition.
