The prosecution of this case is dismissed.
1. On February 21, 2013, around 09:40 on February 21, 2013, the Defendant: (a) committed an indecent act by force against the victim, following the victim D (here, 28 years of age) who gets married in front of the Cdong Office of Osan City; (b) the victim’s sexual organ part of the Defendant’s sexual organ on the victim’s sexual organ.
2. We examine the judgment. It is a crime falling under Article 298 of the Criminal Act, which can be prosecuted only upon the victim's complaint under Article 306 of the Criminal Act. According to the written agreement bound in the trial records, the victim's withdrawal of the complaint against the defendant on March 28, 2013, which is after the prosecution of this case. Thus, the prosecution of this case is dismissed in accordance with Article 327 subparagraph 5 of the Criminal Procedure Act.
