A. (1) On August 23, 2013, the Plaintiff entered into a loan transaction contract with D Co., Ltd. with 200,000,000 won for loans, emergency management safety funds for loan subjects, and principal repayment for one year, and one year for two years, in accordance with the repayment date table of principal and interest. The payment date of interest shall be paid in installments every month on the repayment date of D Co., Ltd., and in the event the repayment of principal and interest is delayed, the interest shall be paid in delay on the repayment date of D Co., Ltd., and the interest rate shall be 4.6% per annum, interest rate shall be 12% per annum, and the interest rate shall be 12% per annum, and the above money was lent to D Co., Ltd. as the representative director of D Co., Ltd., and the debt guaranteed by the said company to the said Plaintiff.

3) The debt owed to the Plaintiff of D is KRW 12,851,041, totaling the principal and interest as of December 23, 2015. B’s disposal of B’s property 1) B borrowed KRW 100,000 from the Defendant on September 10, 2015, and the due date for payment was October 10, 2015, the real estate listed in the separate sheet owned by B (hereinafter “instant real estate”) in the form of transaction promise to secure the repayment of the said loan was offered as security to the Defendant, and was offered as KRW 220,000,000 (hereinafter “instant promise”).

2) B completed the provisional registration of the right to claim ownership transfer registration (Seoul District Court Decision 156595) against the Defendant on the grounds of the same day’s reservation. C. The active and passive property B around September 10, 2015, for which the instant promise to sell and purchase the property of this case was concluded, was in excess of the active property as follows. [affirmative] : (1) The value of the instant real estate: 102,90,000 won; (2) The value of the instant real estate E and the E and the value of the instant land in Chungcheongnam-gun, Jincheon-gun, Jincheon-gun; (3) KRW 92,90,00 [negative: 569,073,476]
