1. The Plaintiff (Counterclaim Defendant) against the Defendant (Counterclaim Plaintiff)

A principal lawsuit and counterclaim shall also be deemed a principal lawsuit and counterclaim.
1. Basic facts
A. On October 12, 201, the Plaintiff received a contract with the Defendant for the new construction of the building listed in the attached Table (hereinafter “instant housing”) (hereinafter “instant construction”) at the contract price of KRW 370,00,000,000 on the date of commencement, February 22, 2012, July 22, 2012, and three years for the warranty period of the defect and warranty period of the instant construction (hereinafter “instant construction”).

However, the Plaintiff did not complete the construction until the completion date of the instant construction project, and obtained approval for use on September 14, 2012, and subsequently performed the construction project to expand the fourth floor thereafter, and delivered the instant housing to the Defendant.

2. Determination on the main claim
가. 원고의 주장 원고는 이 사건 공사 이외에 추가로 1층 근린생활시설을 주택으로 변경하는 등의 25,964,986원의 공사를 시행하여 피고로부터 이 사건 공사와 관련하여 공사대금으로 합계 395,964,986원(이 사건 공사대금 370,000,000원 추가공사대금 25,964,986원)을 받아야 하는데, 여기에서 피고로부터 직접 지급받은 256,000,000원, 피고가 공사업체에게 직불한 70,500,000원(석공사대금 14,000,000원 샷시대금 9,500,000원 석공사대금 43,000,000원 가구공사대금 4,000,000원), 이 사건 공사로 인하여 발생한 하자보수비용 33,458,367원, 원고가 이 사건 공사를 지체함으로써 발생한 지체상금 3,330,000원(2012. 9. 6.부터 2012. 9. 14.까지 9일), 피고가 주차장 하자보수비용으로 들인 비용 133,000원, 합계 363,421,367원을 공제하면, 피고가 원고에게 이 사건 공사 및 추가공사대금 미지급 대금으로 32,543,619원(395,964,986원 - 363,421,367원)을 지급할 의무가 있다고 주장한다.
B. The 1st party’s assertion on the assertion of additional construction cost is based on the agreement between the Defendant and the 1st floor of the instant housing.
