However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

2. 공무집행방해 피고인은 제1항 기재 일시 및 장소에서 위와 같이 D를 폭행하여 D로부터 112신고를 받고 출동한 부여경찰서 E지구대 소속 경찰관 F 등이 피고인의 위 D에 대한 폭행을 제지하자, 위 경찰관 F에게 “너 짭새. 너는 빠져라. 이 새끼야.”라고 말하면서 손을 들어 위 경찰관 F을 때리려고 하였고, 이에 위 경찰관 F이 욕설을 하지 말고 위 D로부터 떨어질 것을 요구하자 위 노상에 있던 입간판과 화분을 집어 들어 위 경찰관 F에게 던지는 등 폭행하였다.
