1. The defendant is within the scope of property inherited from the deceased B (C) and KRW 90,94,548 and among them 20,298.
The following facts are acknowledged according to the evidence Nos. 1 to 6 and the purport of the whole pleadings.
On May 30, 2003, the Plaintiff loaned 20,800,000 won to D on May 30, 200 at 48 months of the loan and 24% per annum of the delay damages, and B guaranteed D's debt.
As a result of the obligor's loss of benefit, the Plaintiff filed an order for payment of the guaranteed debt with the Gwangju District Court 2008 teaM48 with the Gwangju District Court 2008.23 February 23, 2008. The payment order for B's guaranteed debt is finalized on April 15, 2008. B's guaranteed debt is 90,94,548 won and 20,298,121 won with the rate of 24% per annum from November 4, 2016 to the date of full payment.
On July 5, 2014, B died and succeeded to the property of the Defendant, and on October 15, 2014, the report of inheritance limited recognition was accepted by the Gwangju Family Court 2014Ra1480.
Therefore, the defendant is obliged to pay the above inheritance obligation within the scope of the property inherited from the deceased B.
