The prosecution of this case is dismissed.
Reasons
1. At around 17:00 on July 29, 2019, the Defendant assaulted the victim D (Nam, 52 years of age) who was aware of the usual influence at the play place following the Gambling Ba-si store, Gambling-si, 2019, and the victim d (ma, 52 years of age) who was under drinking, with the victim’s desire to take the alcohol on his/her hand at one time.
2. The offense of assault can not be prosecuted against the victim’s express intent (Article 260(3) of the Criminal Act). Since the victim expressed his/her intention not to prosecute the defendant after instituting the prosecution, the prosecution of this case is dismissed in accordance with Article 327 subparag. 6 of the Criminal Procedure Act.
